Order 18 Rule 4 of the Code of Civil Procedure (CPC) in India is related to written evidence of the plaintiff or defendant. It states that in any suit, the written statement of the defendant shall contain a statement of the facts on which the defendant relies for his defense, and the documents or evidence, if any, on which the defendant intends to rely in support of his defense.
Similarly, the written statement of the plaintiff shall contain a statement of the facts on which the plaintiff relies for his claim and the documents or evidence, if any, on which the plaintiff intends to rely in support of his claim.
This rule helps to ensure that the parties to the suit are aware of the evidence that the other party intends to rely on during the trial, and that the court is aware of the evidence that will be presented during the trial. This allows the court to make a fair and just decision in the case.
