What is Mutual divorce and what does legal separation mean? 
A mutual consent divorce is a kind of legal separation in India when both the husband and 
wife want to terminate their marriage. As per the Hindu Marriage Act, of 1955, both 
husband and wife can file a petition for the dissolution of their marriage with a mutual 
divorce agreement and certain divorce conditions. Both of them must agree to comply and 
file the case without any undue influence.  
What are the 1st and 2nd Motions of legal separation in India?  
The procedure to seek a divorce agreement will be passed in two motions jointly in a 
stipulated time.  
The first joint petition for the marriage separation will be filed in the 1st motion. In 1st 
motion statements of both husband and wife are recorded. After the passing of the 1st 
motion, a period of 6 months is given before filing a petition for the 2nd motion. That shall 
be filed before the court within 18 months from the date of presentation of divorce in the 
family court. After the second motion, the court grants the final decree of their mutual 
divorce agreement.
